Labor Acts, FLSA Coverage, and Retirement

Several states have endorsed higher minimum wages while they have also extended their laws that even workers who are not covered by FLSA or are not recognized by federal law are included. Additionally, local governments have also coined various living wage laws that compel their contractors to giver higher minimum wages and benefits to their employees.
Employee Retirement Income Security Act
The Employee Retirement Income Security Act (ERISA) decides on the standards that need to be followed in relation to funding and operating pension and health care plans offered to employees. ERISA disregards state legislations that are geared towards regulating the administration and the type of pension and healthcare plans provided. ERISA also prevents situations where employees may claim discrimination by employee and hence denial of benefits.
Family and Medical Leave Act
The Family and Medical Leave Act of 1993 necessitate the provision of twelve weeks unpaid medical leave as well as continual medical benefit coverage to employees. This is necessary for employees to have the chance to look into their medical conditions or those of their close relatives. Statutory provisions of this act differ in respective states since there are better protections in some states than in others.
Occupational Safety and Health Act
Enacted in 1970, the Occupational Safety and Health Act (OSHA) gives recommendations for safety at the work place. The Act has faced several challenges put forth by industry groups who challenge the standards set for chemical exposure permitted. This act attempts to protect employees who protest unsafe working conditions. It allows workers to recognize that it is their right to work under safe conditions and to refuse anything less. Additionally OSHA also allows states to adopt its authority.
