On June 22, 2011, the NLRB proposed amendments to the  rules of procedure for representation cases in an effort to shorten  election procedure and simplify the entire process. They have eliminated  what they consider unnecessary steps in filing, reduced excessive  elections, and modernized the process through use of electronic  communication.</p>
<p>Following are the proposed amendments and the way current procedures differ:</p>

<p>Following are the proposed amendments and the way current procedures differ:</p>

<li>The NLRB would be allowed to deliver petitions and notices for  elections via email or any other electronic avenue. Currently, parties  cannot file or transmit documents electronically.</li>
<li> The parties will now receive more assistance prior to elections by  receiving a Statement of Position form, a list of their rights and  obligations, and details of the procedure in representation cases. They  will be permitted to complete this form at the pre-election hearing.  Currently, the parties do not receive this assistance.</li>
<li> Pre-election hearings will be set 7 days after service of the notice,  and 14 days after tally of the ballots. The time frames currently vary  by region, but they are longer.</li>
<li> Before evidence is accepted, the parties must state their positions.  Currently, this provision is lacking, making it difficult to know the  exact nature of the dispute.</li>
<li> A challenge procedure during the election will be allowed for any  disputes to voter eligibility. Current procedures allow only  pre-election litigation to resolve this issue.</li>
<li> A list of voters is provided, usually by the employer; to the  petitioner, usually the union up until the opening of the pre-election  hearing. This will make it easier for unions and other petitioners to  identify eligibility issues before the election. Currently, a list of  voters is not provided.</li>
<li> Parties may seek a review of all the rulings through one request after  the election, and any pre-election requests would be removed.  Currently, the request must be made prior to the election or their  rights are waived.</li>
<li> The union will now have the discretion to deny review of post-election  rulings. This will allow regional directors to make final decisions,  instead of the union doing so.</li>
<li> The final list of voters will be produced electronically when  possible, within two days, and include names, home addresses, phone  numbers, and email addresses. Currently, the voter’s lists are in paper  form, and include only names and home addresses.</li>
</ul>
<p>The NLRB claims that these changes will resolve representation issues by  simplifying the election procedures, eliminate unnecessary litigation,  and create uniformity and clarity across regions. They contend that  these amendments will also help to consolidate requests to the union for  pre- and post-election determination.</p>
<p>On the other hand, the ability of an employer to discuss the impact of  joining a union and collective bargaining with workers may be weakened,  not to mention discussing employee concerns prior to an election. With  what some refer to as a quickie election, it is feared that employers  will not have the time to express their views on collective bargaining.  This would make it easier for private unions to win representation  elections. Many anti-union employers fear it could lead to an increase  in union representation.</p>
<p>The NLRB has also proposed a rule requiring every private employer to  post a notice of the National Labor Relations Act – NLRA rights for  employees to unionize. The NLRB’s reason for this is to increase  knowledge of the NLRA among employees. They assert that employees will  be better able to exercise their rights under the statute and that it  encourages statutory compliance by employers and unions.</p>
<p>In order for employers to be in compliance, new <a href="http://www.hrdirect.com/solutions/laborlaw/default.aspx">labor law posters</a> must be clearly  displayed and visible in offices and in plants where employees covered  by the NLRA perform their duties. Poster updates should be received by  employers as soon as they occur.</p>
<p>According to the website, Vorys on Labor, the poster should state that employees have the right to:</p>
<ul>
<li> Act together to improve wages and terms and conditions.</li>
<li> Form, join, or assist unions.</li>
<li> Bargain with their employer.</li>
<li> Discuss union organizing with co-workers or a union.</li>
<li> Raise work related complaints with their employer, a governmental agency, or a union.</li>
<li> Strike and picket.</li>
<li> Choose not to engage in any of these activities.</li>
</ul>
<p>The notice would also provide examples of illegal employer and union  conduct, as well as instruct employees how to contact the NLRB with  questions or complaints.</p>
<p>On July 18, 2011, the NLRB will hold an open meeting on these proposed  changes at their headquarters in Washington D.C. to consider input from  interested parties. It is too late for registration to attend, but all  the information on the meeting can be found at the NLRB’s website or at  the Federal Register’s website.</p>

Just when you thought you were “getting there,” social media adds another partner in crime: Ecommerce. You can now sell your products and services on a main social network: facebook. It has launched the facebook store for pages. You can sell everything from tshirts and other products to your legal services.  No need for your own merchant account or <a href="http://www.merchantexpress.com/virtual-terminal.htm" target="_blank">virtual terminal</a>; facebook does all the work for you! Apparently talking about, rating and giving your feedback about products wasn’t enough.</p>

<p>But now things have moved more and more towards the digital. The new age is set firmly online, where social media and networking dominate in a way we couldn&#8217;t have even dreamed just a decade ago. Changes in how we share information make it a hot place or marketing in any profession, which is why it is a shock that more legal firms have not jumped on board to take advantage of a craze that is only beginning, and isn&#8217;t likely to fade but instead grow and evolve over time.</p>
<p>According  to an article in the <em>ABA Journal</em>, the problem is less to do with a desire to remain using a traditional format and more to do with the risks posed online. Rachel Zahorsky wrote that there is a real gap between out of date laws related to sharing information, and what ends up being released online. Jurors have even been cited many times for texting or tweeting the details of cases in the middle of deliberations or while hearing testimony. More than one mistrial has been the consequence of such idiotic actions.</p>
<p>But that doesn&#8217;t mean that no one has stepped out to try and use social networking to their advantage. Here are a few common ways that lawyers and firms are taking a step into the new age to reach a wider client pool.</p>
<h2>Blogging</h2>
<p>Blogging is a great option because you are already operating in a general niche, so you can further isolate yourself as an expert by writing about your specialty. For example, if you work mainly in civil cases involving auto accidents and driving violations, you can stick to that and target a direct audience.</p>
<p>So far it is almost exclusively small firms and individual lawyers who are taking advantage of this. They create a market for themselves and establish their names as trusted experts. It has been wildly successful, and you sometimes have a small handful of attorneys who operate as the best in a state simply based on their blogs.</p>
<p>Sadly, big firms have not really gotten on board with this method. The fear seems to be that if they allow lawyers to blog under their own names or somehow establish credit they will be branding themselves. This could potentially give them a reason to leave and take that business with them, which would not be in the interest of the firm at large.</p>
<p>But that kind of thinking in outdated and show that they might just be missing the point of blogging. They can do the articles under the basic name of the firm, or they can give their attorneys the chance to putt heir name out there. Either way, it connects directly to that firm, and so can only have a positive effect as a whole. Even if the attorney were to leave later on, that connection would still be there. Those links can be very beneficial.</p>
<h2>Social  Referrals</h2>
<p>The more common method of getting referrals seems to be through attracting new, random clients that can generate business. But while this works for many other categories of marketing, it isn&#8217;t usually the best means of bringing in traffic when it comes to the legal profession. In fact, if you are anything but a new firm or attorney looking to build a first wave of customers, it can have a more negative than positive effect.</p>
<p>Rather than go about things this way, you should be taking the time to create and cultivate long lasting links. The best way to do this is to travel within the network yo already have established, not cast your net out into the darkness and hope to wrangle in a couple of choice options. That means looking to people you already know, clients you have worked with, connections with businesses and firms you have worked with before, and trying to groom those links to the best of your ability.</p>
<p>The good news is that these referrals are easy to come by in the world of social networking. Whether you locate and follow other blogs, join business pages or just set up a Facebook or LinkedIn page for people to share and connect to, you can quickly widen that network to bring in people who are connected in some way to those you already know or have worked with.</p>
<p>Commenting on blogs, statuses and looking out for relevant posts is another good way to do this. It shows you are interested, not just a faceless firm looking for pointless boosts from strangers.</p>
<h2>Insights  VS Legal Advice</h2>
<p>I have lost count of the amount of times I have seen people fail to demarcate the difference between sharing insight from a personal view and actual legal advice that can be used for a case. Logic would seem to indicate that people would know not to enact a defense or take an action that was expressed on a blog, but you have to err on the side of caution and assume that some people have to have the finer points of this issue spelled out for them.</p>
<p>For the same reason that many sites indicate that they are for entertainment purposes only, you should also provide a disclaimer. It should specify that nothing you post constitutes real legal advice and a consultation should be sought in regards to any problems or cases pending. That includes on social media profiles.</p>
<h2>Get  Personal</h2>
<p>You might be tempted to remain anonymous, business like and completely professional on your blog or social media profile. After all, you are representing an old and serious profession that helps change the course of both lives and whole societies.</p>
<p>While a certain amount of professionalism should be maintained for the sake of propriety, you shouldn&#8217;t be afraid to get personal. Be friendly and let people know who you are. Talk to them one on one, showing the real faces behind the firm. Joke when you can, take an interest in their own posts and updates, and make friends. While it is unlikely it will go beyond business relationships, those will be strengthened if you actually like one another and have a better connection than a printed postcard at Christmas and a stiff update about your case availability.</p>
<h2>Get Out There!</h2>
<p>Social media is unavoidable, and if you do it right you will be taking a real step towards a more active and sociable firm. Failing to make this shift in mindset could leave you behind and unable to keep up with others who got on board. Don&#8217;t take that chance.</p>
